House Rules

These house rules (hereinafter referred to as the ‘House Rules’) have been issued and approved by Mountfield HK, a. s., with its registered office at Komenského 1214/2, 500 03 Hradec Králové, IN: 019 16 441 (hereinafter referred to as the ‘Operator’), and they cover the sports facility referred to as the ČPP Arena, including its outside areas that are part of the ice hockey arena at Komenského 1214/2, 500 03 Hradec Králové (hereinafter referred to as the ‘ČPP Arena’ or the ‘Venue’). The Operator may make reasonable changes to the House Rules, always with effect after the change is made public on the Operator’s website at www.mountfieldhk.cz (in the Venue section) and at the same time in the Venue ticket office area and outside each Venue entrance.

Each person entering the ČPP Arena (hereinafter referred to as a ‘Visitor’) confirms they have read and agree to the contents of the House Rules and undertake to respect and comply with them.

The House Rules lay down the requirements for the safe operation of the ČPP Arena, including the protection of safety, health and property at the Venue, as well as ensuring, as far as possible, ideal conditions for all events. The House Rules must be unconditionally observed by all Visitors. The aim of the House Rules is also to ensure an amiable sporting and social atmosphere.

VENUE ACCESS

  • 1. To enter the Venue and attend a specific event, a Visitor is required to produce a valid, properly marked ticket or other document that demonstrably grants them entry to the facility (except for free-admission events) by attaching the ticket to a scanner/turnstile or presenting it to the Operator and/or the Organiser. By attaching the ticket to the scanner/turnstile or by presenting it to the Operator and/or the Organiser upon entry, the Visitor confirms they are entering the correct sector or specific seat marked on the ticket. Visitors are required to make any complaints regarding the purchase of the ticket before entering the Venue, immediately after purchasing the ticket.
  • 2. Visitors agree that their access to the Venue is limited to certain areas only, and the Operator and/or the Organiser is entitled to unilaterally determine, where justified, that a ticket giving the Visitor access to certain parts of the Venue can only be purchased if conditions that have been announced previously are met.
  • 3. The ticket entitles the Visitor to watch the events on the Venue surface only in the sector and seat designated by the ticket.
  • 4. The ticket can be presented in paper or electronic form (QR code, etc., in a portable device) with a validation feature. Multiple tickets can be stored on one device for a given day/event. To re-enter the Venue with a single ticket during an event, it is necessary to check out, i.e., have the ticket read by the scanner/turnstile when leaving the Venue. A Visitor who fails to check out in the above manner, may see their ticket denied when trying to re-enter the Venue. The decision on their right to enter rests with the Operator and/or the event Organiser.
  • 5. Visitors are not only required to present a valid ticket or ID card upon entry but also, where justified, at any time during the event (e.g. due to suspicion of violation of the House Rules, violation of the prohibition to attend the event, etc.). For this purpose, Visitors are required to keep the tickets on their person to be able to re-produce them at any time. If a Visitor fails to produce a valid ticket, they will be asked to leave the Venue; if they do not comply, they will be escorted out.
  • 6. The Operator and/or the Organiser reserve the right to conduct security searches of Visitors upon entry and, where justified, during their stay at the ČPP Arena. Visitors are obliged to tolerate these searches and produce their ID at the request of the Operator and/or the Organiser. Security searches shall be carried out, inter alia, to check compliance with the ban on bringing inappropriate items specified in Article 7 and to minimise risks during events held at the Venue. If a Visitor refuses to submit to a search, the Organiser and/or the Operator shall have the right to deny the Visitor entry to the Venue without the Visitor becoming entitled to a refund of the admission fee, or expel the Visitor from the Venue premises, or seize or confiscate any inappropriate item without compensation. Visitors are also required to have their luggage (backpacks, handbags, suitcases, etc.) checked by security.
  • 7. It is forbidden to bring any dangerous items, materials and products into the Venue that could endanger the safety of people at the Venue, which could cause damage to health or property (e.g. explosive substances, flammables, bangers, rods, weapons of any kind), as well as alcohol, drugs and other toxic and narcotic substances. Whether, or not, an item poses a security risk will be unilaterally assessed by the Operator and/or the Organiser.
    • Furthermore, Visitors are prohibited from bringing their own food and beverages, bottles and containers of any kind (glass, PET bottles, cans and jars, etc.), pressurised items, glass or glass items, scissors, bicycles, scooters, electric scooters, skateboards, longboards, pennyboards, wakeboards or other means of transport, as well as excessive luggage into the Venue.
    • Visitors are also prohibited from bringing any type of recording devices, including data, video and audio, except for mobile phones (barring exceptions granted by the Operator and/or the Organiser) and political and advertising materials into the Venue, unless the Visitor has been granted prior consent by the Operator and/or the Organiser.
  • VISITORS’ CONDUCT AT THE VENUE
  • 8. Visitors undertake to follow the instructions and comply with the calls of the Operator, Organiser, their staff on duty and the security personnel, the announcer, as well as any instructions of members of the Police or the Integrated Rescue System, which serve to ensure safety, maintain order and protect health and property.
    • Visitors who fail to follow the Organiser´s instructions or to comply with these House Rules may be removed from the Venue by the Organiser without being entitled to any compensation.
    • For safety reasons and to avert danger, Visitors may be required to take a different seat than that indicated on the ticket, possibly in a different sector, at the direction of the Operator, Organiser or a police officer (member of the Police of the Czech Republic, Security Force, etc.). This will not give rise to the right of the Visitor concerned to claim any discount on the price of the admission ticket.
  • 9. Visitors are required to avoid any behaviour that could result in damage to the Venue, its equipment or property of other Visitors or third parties. Similarly, Visitors are required to follow the rules of good conduct and good manners and not to restrict other Visitors of the event by their behaviour.
  • 10. Visitors are required to immediately report any accident or any other emergency to the nearest employee of the Organiser and/or the Operator, who will arrange treatment or call for medical assistance from the first aid room or from the reception. Visitors are also required to immediately report any irregularities identified in the Venue equipment that threaten the safety of Visitors and Venue users to an employee of the Organiser and/or Operator, to a staff member on duty or to the officers at the Venue´s reception.
  • 11. Visitors acknowledge that they participate in the events held at the Venue at their own risk. The Operator and/or the Organiser shall not be liable for any damage suffered by Visitors during cultural or sporting events as a result of force majeure or third party actions. By participating in an event, Visitors waive any claims against the Operator or Organiser on account of any injury suffered as a result of an ongoing game or the actions of other Visitors.
  • 12. The Operator and/or the Organiser of the event shall not be liable for any damage, accidents or injuries suffered by Visitors caused by inattention, carelessness, indiscipline or failure to comply with these House Rules and the operating rules of the individual facilities in the Venue premises or the instructions of the responsible staff of the Operator and/or the Organiser. All damage caused by inappropriate Visitor behaviour (failure to respect the measures in place within the meaning of these House Rules) shall be enforced and penalised in accordance with the applicable laws of the Czech Republic.
  • 13. Visitors are required to only keep their belongings in the places directly designated for this purpose. The Operator and/or the Organiser is not responsible for the loss of any items or money left in other areas of the Venue. Visitors are required to transmit any foreign items they find in the Venue premises to the reception or to the staff of the Operator and/or the Organiser, who will arrange for the safekeeping and later handover of the items to their respective owners.
  • 14. Visitors are required to comply with all current emergency measures put in place by public authorities, in particular by the Ministry of Health, by their subordinate authorities or by the Operator, with a view to preventing or avoiding the spread of epidemics, diseases, contagions or other hazards of any kind. Visitors are required to submit to such actions as proving they are free of infections, wearing respirators, not gathering, observing the minimum spacing, using disinfectants at entrances and toilets, etc. In connection with any extraordinary measures in place, the Organiser reserves the right to change the entry system used at the Venue, including by changing the sector, row and seats that go with any purchased one-off/season tickets.
  • 15. Visitors are expressly forbidden to engage in the following activities within the Venue premises:
    • a. smoking, using electronic cigarettes or handling naked flame in any way;
    • b. entering the Venue with animals;
    • c. littering at the Venue, e.g., throwing rubbish or other things around;
    • d. throwing any items onto the ice surface or production area or into the stands, both during games and other sporting and social events and outside such events;
    • e. entering and moving around the Venue with a masked face, with their face covered or with any other item that makes it difficult for them to be identified, except where by doing that they comply with the obligations set by public authorities;
    • f. entering Venue premises other than those defined by the ticket or areas open to the public (e.g. the ice surface, players’ dressing rooms, referees’ dressing rooms, players’ bench, penalty bench or other areas reserved for delegated persons and representatives of the governing body) before, during and after the event. Visitors are only allowed to move onto the ice during competitions held there during breaks and only on the instruction of an event moderator. Visitors take part in such competitions at their own risk;
    • g. engaging in any fights, physically assaulting the Operator and/or the Organiser, other Visitors, security personnel or other people present at the Venue;
    • h. displaying gestures or behaviour that are in any way vulgar, aggressive, abusive, derogatory, insulting, provoking, mocking or humiliating, offensive or immoral (such as gesturing, shouting or other unsportsmanlike behaviour),
    • this prohibition also includes speeches denigrating any nation, race, religion or ethnic group or any individual or group of persons on the basis of their actual or perceived race, ethnic group, nationality, political beliefs, religion or sexual orientation, directed at any people at the Venue;
    • i. making video, audio or audiovisual recordings of the event, the Venue or people in it for commercial, advertising, political, journalistic or other similar purposes without the prior written consent of the Operator and/or the Organiser and without obtaining a designated accreditation;
    • j. covering advertising panels located within the Venue with flags or any other means;
    • k. hindering or preventing other Visitors from moving freely around the Venue, blocking the escape routes, etc.
  • 16. Visitors who violate any of the explicit prohibitions under the preceding paragraph of these House Rules shall pay the Operator a one-time contractual penalty of CZK 50,000 for each such individual violation. The contractual penalty is payable on demand by the Operator. At the same time, the Operator reserves the right to remove a Visitor who violates any of the provisions of the House Rules from the Venue without any compensation for the Visitor. The Operator shall additionally be entitled to prohibit such Visitor from attending any further events organised by the Operator at the ČPP Arena for a period of up to 10 years. If the Visitor has visited the Venue on the basis of a season ticket, the ticket shall be invalidated, without the Visitor being entitled to a refund of the admission fee.
  • 17. The Operator’s right to payment of contractual penalties is without prejudice to the right to full damages.

CCTV SYSTEM, PERSONAL DATA PROTECTION AND OTHER INFORMATION ABOUT THE VENUE OPERATIONS

  • 18. By entering the Venue, Visitors agree, in accordance with Section 84 of Act No. 89/2012 Coll., the Civil Code, as amended, to their appearance being captured by means of visual, audio or audiovisual recordings (e.g. photographs, films, video recordings, hereinafter referred to as ‘Recordings’) during their presence at the Venue and by means of the CCTV system or any other technical method, all solely for the purpose of protecting the legitimate interests of the Operator. Visitors further acknowledge that these Recordings may be forwarded to the Police of the Czech Republic and the Municipal Police, the Association of Professional Clubs, Czech Ice Hockey Association and other entities where justified. Visitors also consent to the standard use of the Recordings by the Operator. Standard use denotes use of the Recordings for the purpose of internal Venue broadcasting, editing of spots and photographs with a view to promoting the Venue and the Operator, including on the Operator´s website. The consent under the previous sentence is granted by the Visitor without any claim for compensation and without any time and space limitation.
  • 19. Visitors acknowledge that the entire Venue and adjacent areas are monitored by a CCTV system, which produces recordings.
  • 20. In connection with their participation in the event organised at the Venue, Visitors agree to their personal data provided to the Operator and/or the Organiser and/or obtained by the Operator in the aforementioned manner (e.g. by making the Recordings) being processed (in particular through the capture of their appearance). The Operator and/or the Organiser may only process or disclose the Visitors’ personal data to other recipients for the purpose of fulfilling their contractual obligations, protecting their own legitimate interests and promotion as stated above.
  • 21. Visitors acknowledge that the Operator and/or the Organiser may process their personal data for the time necessary without their explicit consent, if this is necessary to safeguard the safety of people, property and legitimate interests of the Operator and/or the Organiser. The Operator and/or the Organiser may process personal data to the extent necessary to identify any person who has committed a serious violation of the House Rules or other unlawful conduct at the Venue (in particular the name, surname, date of birth of the person as well as photographs, camera footage and description of the conduct that is considered to be in violation of the House Rules or generally binding laws). If a Visitor seriously violates these House Rules (e.g. if they cause injury to another person, damage to property), their personal data may be transferred to the Czech Ice Hockey Association, the Association of Professional Clubs, other clubs and other entities for the same purpose in justified cases, to the extent strictly necessary.
  • 22. The Operator and/or the Organiser reserve the right to deny entry to the Venue or to remove from the Venue, without a refund, any person who
    • fails to produce a valid ticket, or
    • refuses to submit to an entry or security check, or
    • has been banned by the Organiser, a public authority or the organisers of similar events (e.g. other ice hockey clubs operating in the Czech Republic) from attending similar events on account of their inappropriate behaviour, or
    • has already violated the House Rules during cultural or sporting events held by the Operator and/or the Organiser in the past, or
    • is clearly under the influence of alcohol or addictive or psychotropic substances
    • or is reasonably suspected of having committed a serious act against other Visitors, public order, violation of these House Rules, good manners or generally binding laws at the Venue.
  • 23. If the Operator is sanctioned by the Czech Ice Hockey Association or the Association of Professional Clubs to close the whole Venue or any of its parts to spectators for any specific game, or if the Operator is sanctioned by having to close the Venue for the Czech Extraliga games, Visitors are not entitled to a refund of the paid ticket or a proportional part of their season tickets. Visitors will be asked to leave the sector and use the available seats in the hall if the ban applies to their seat, or to leave the Venue if the hall is sold out.
  • 24. If, after the end of a first-team game, children and youth under the age of 15 are granted access to the outer rink boards from the S and N sectors at the direction of the Operator and/or the Organiser, and if they are granted access to the players’ bench to thank the players, the Visitors may not climb the rink boards or enter the ice surface. Visitors are required to exercise increased caution and consideration towards other Visitors during their stay at the ice rink; the same applies to any accompanying persons, who are required to provide supervision and are responsible for the actions of the people they accompany in the said area. The Operator and/or the Organiser may restrict or cancel access to the ice surface.

The event organising services provided to ensure security at all games of the Operator´s ice hockey club held at the ČPP Arena are provided by BERRY BROTHERS AGENCY, s.r.o., with its registered office at Elišky Krásnohorské 10/2, Josefov, 110 00 Prague 1, IN: 054 43 253 (referred to above as the ‘Organiser) at their own expense and risk.

ENTRY INTO FORCE

These House Rules enter into force on 17 September 2023.
